SCOTUS to Hear Jack Daniels’ Trademark Dispute

The Supreme Court, Jack Daniel’s, and a company that sells dog toys–this one has all the makings of a good joke but is a serious intellectual property (IP) case headed to our nation’s highest court. The U.S. Supreme Court has decided to hear a trademark dispute stemming from objections by Jack Daniel’s to a dog toy company using a design that resembles the whiskey brand’s “Old No. 7” label. The issue at the case’s core is whether the “Bad Spaniels” toys are an expressive work covered by First Amendment protections. Our trademark attorneys will be watching this case. Learn more here.
